Welcome to CloneCast (“Platform”), operated by CloneCast Inc. (“Company,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Platform.

1. Acceptance of Terms

By accessing or using CloneCast, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, whichever is greater, and have the legal capacity to enter into this agreement.

2. Description of Services

CloneCast allows users to create, share, and interact with AI-generated digital versions of people, referred to as “Casts.” The Platform also provides tools for managing and sharing these Casts within the bounds of applicable laws and our community guidelines.

3. User Responsibilities

• Account Security: Users are responsible for maintaining the confidentiality of their account credentials.

• Content Ownership: Users retain ownership of any original content they upload to the Platform but grant CloneCast a non-exclusive, worldwide, royalty-free license to display, distribute, and use such content for Platform-related purposes.

• Prohibited Conduct: Users must not:

  • Upload or create content that is provocative, incites violence, promotes racism, hate speech, or violates any laws.

  • Use the Platform for illegal or unauthorized purposes.

  • Misrepresent another person, including public figures, without explicit permission or legal authorization.

4. Content Moderation

The Company reserves the right, at its sole discretion, to remove or restrict access to any Cast or content that:

• Incites violence, hate, or racism.

• Violates laws or promotes illegal activities.

• Harasses, bullies, or threatens others.

• Is deemed provocative or in violation of our standards of free speech and community guidelines.

• Breaches intellectual property rights or privacy laws.

• Fails to meet the quality standards of other Casts on the Platform. In such cases, we may deactivate and make non-live a Cast that was created in good faith but is below par with other Cast standards. During this process, we may intervene to better or enhance the Cast for the creator. Upon registration, you enable the Platform the right to do so.

Decisions regarding content removal are final and not subject to appeal.

5. Intellectual Property

All software, design, and branding elements of CloneCast are the exclusive property of the Company. Users may not copy, distribute, or modify these elements without prior written consent. CloneCast is without liability for any Cast created on the Platform and will remove content based on requests by the copyright or legal holder of the intellectual property.

6. Privacy Policy

Your use of CloneCast is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Platform, you consent to the terms of the Privacy Policy.

7. Disclaimers and Limitation of Liability

• No Guarantees: CloneCast is provided “as is,” and the Company makes no guarantees regarding the availability, reliability, or accuracy of the Platform or its content.

• Limitation of Liability: To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

8. Termination

We may suspend or terminate your account without notice if you breach these Terms or engage in conduct that we deem harmful to the Platform or its users.

9. Governing Law

These Terms are governed by the laws of European Union, without regard to its conflict of laws principles.

10. Changes to Terms

We may update these Terms at any time, and changes will be effective upon posting. Continued use of the Platform constitutes acceptance of the revised Terms.
